Agents Negotiate Short Sales, Leave Lawyers Out
We are joined at present by Bryan Choate, a very exceptional guest with a message to share. Last Friday we renamed our Friday video, “Freaky Friday” with the intention of saying that there are things out there in the short sale trade that are scary. We want you to be conscious of those things.
Bryan has been a broker for a long time and he believes that, as a real estate commune, it is time for us to stand up and do the negotiation on our short sale packages. If we do not want to negotiate our own files, we should be referring them to other real estate specialists. We need to stop referring these files to attorneys. Lawyers are for giving counsel and representing people in court. They are not for negotiating short sales.
Like many real estate specialists, Bryan was trapped in the real estate shift. When he first started dealing with short sales, he did not want to deal with the negotiations. So, with the thought that he was protected, he referred the negotiations to lawyers. Nonetheless, they just completed approximately 25% of the folders that were sent to them. The last straw for Bryan was when the lawyers that he hired to negotiate his best friend’s short sale couldn’t or did not want to go the extra mile to close the agreement.
When realtors sit across from a consumer and advise them that they will not permit their house to go to foreclosure, that means something! Short sale specialists should not acknowledge foreclosure as an alternative. If you can not take that mindset into a short sale transaction you should not be taking short sale listings. Lawyers do not have the knowledge of the real estate market to even begin negotiating short sales. Agents need to negotiate short sales. PERIOD!
