How does my friend proceed with a divorce if his wife is in Japan & he’s in the US? She also refuses to sign?

My friend wants to divorce his wife who lives in Japan, but she refuses to sign the papers. He though lives here in the states. How can he go about proceeding in this divorce?

You really need to talk with a divorce lawyer where you live. It’s different for every state, and it also depends on what connections the wife has with the state where it’s filed. You need to know what “contacts” the wife has with the state to determine whether the state has “long arm jurisdiction” over the wife, which will determine whether he can hire a process server to tag her in Japan, or maybe serve her by posting or by publication.

Once she has been served, she has a limited amount of time (probably less than a month) to get papers on file with the court, saying “I’m here”, and if she doesn’t, your friend can proceed toward a default judgment (getting the judge to sign the papers because the wife blew it off).

If she does get an Answer on file (or whatever it’s called in your state), if she still does nothing, you can set the matter for trial, which may be comparatively inexpensive if you really don’t expect the wife to show up.
